Agreement Between Investigative Agency DSSC and End User

This Agreement ("Agreement") is entered into as of [Date], by and between Diligent Search Service Center (DSSC) and DCFS End User

Purpose

The purpose of this Agreement is to establish the terms under which DSSC will provide investigative information to the End User for the exclusive purpose of child welfare investigations, in compliance with the Fair Credit Reporting Act (FCRA) and other applicable laws.

Permissible Purpose

The End User agrees and acknowledges that the investigative information obtained from DSSC will be used solely for child welfare purposes. This includes but is not limited to:

Evaluating potential foster or adoptive parents

Assessing the suitability of individuals involved in child care or other child-related services

Compliance with FCRA

Both parties agree to comply with the FCRA, which includes but is not limited to:

Obtaining written consent from the individual being investigated

Providing a clear and conspicuous disclosure to the individual that a background check will be conducted

Ensuring that the information obtained is accurate and used solely for the purpose of child welfare investigations

Responsibilities of DSSC will:

Obtain and verify all necessary consents and disclosures

Use reasonable procedures to ensure maximum possible accuracy of the information reported

Provide a copy of the report to the End User and the individual upon request

Maintain the confidentiality of all information obtained during the investigation

Responsibilities of the End User:

Use the information provided by DSSC solely for child welfare purposes as defined in this Agreement

Maintain the confidentiality of the information received

Comply with all applicable laws and regulations in the use of the information

Provide necessary support to DSSC in obtaining required consents and disclosures

Confidentiality and Data Security

Both parties agree to maintain the confidentiality of all personal information and data obtained during the investigation. DSSC will implement appropriate measures to protect the data from unauthorized access, disclosure, or misuse.

Term and Termination

This Agreement will commence on the effective date and continue until terminated by either party with [Number] days written notice. In the event of a breach of this Agreement, the non-breaching party may terminate the Agreement immediately upon written notice.

Indemnification

Each party agrees to indemnify, defend, and hold harmless the other party from any claims, damages, liabilities, and expenses (including reasonable attorney's fees) arising out of or in connection with any breach of this Agreement.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of [State], without regard to its conflict of law principles.

Entire Agreement

This Agreement constitutes the entire understanding between the parties and supersedes all prior discussions, agreements, or understandings of any kind. Any amendments to this Agreement must be in writing and signed by both parties.
